Tarrio was not charged with joining the rioters. Two days earlier, he was charged with burning a banner at a pro Trump rally. He was released at 5 p.m. Jan. 5 and told to leave Washington.

Prosecutors said that he didn’t immediately comply with the order. According to the indictment, he was allegedly found near the Capitol at an underground parking lot with Elmer Stewart Rhodes (founder and leader of the Oath Keepers) and other far-right groups. According to the document, one of them “referenced” the Capitol.

The indictment does not provide any additional details regarding the alleged meeting. Rhodes, along with 10 other Oath Keepers, were charged with seditious conspiracies. They are accused of plotting to commit acts of violence in order to prevent Congress from counting electoral votes.

Tarrio appeared via video from Miami on Tuesday for a short court hearing. Prosecutors stated that they would request the judge to hold Tarrio until his trial. A hearing for detention was set for Friday.

According to the Justice Department, more than 775 people were arrested in almost all 50 states for cases related to the breaching of the Capitol. This includes over 245 who were charged with assaulting and impeding law enforcement.
