Tarrio was added to an indictment that already charged other members of the far right group with plotting to arrive in Washington with tactical gear to stage protests against the electoral vote count on January 6. They were accused of being the first to break through the Capitol barricades and force their way inside the Capitol.

A host of new details were added to the Tuesday revised indictment. According to the indictment, a member from the Proud Boys leadership sent an email to a small group on December 20, 2020: “I am assuming that most of the protests will be at capital building given what’s happening inside,” the message stated.

Tarrio received a document of nine pages from a person he was communicating with ten days later. It was titled “1776 Returns”, according to prosecutors. The file contained a plan for occupying the Senate and House offices near the Capitol.

According to the indictment, discussions among a small number of Proud Boy leaders changed in the days preceding the riot and shifted their focus to the Capitol. “On January 3, as efforts for planning for January 6 intensified,” according to the indictment, “Tarrio stated that he did not want to wait until January 4, to make final plans.”
