In an initial request for $50 million, the “Pirates of the Caribbean” star sought to pay out for a 2018 Washington Post editorial she wrote. It didn’t name him but did discuss her experiences with domestic abuse by a former partner. Heard counter-sued for $100 million in damages.

In an unusual twist, Heard’s legal team filed for mistrial Friday alleging that the wrong jury member was present throughout the trial.

The “Jury Panel List” included an individual who was born in 1945.

This would have meant that the individual would have been 77 in the course of the trial. The filing claims that a 52-year-old individual, who lives at the same address, was summoned to jury duty and served as a member of the jury.

“The person who appeared on jury duty with this name was clearly the younger one. According to the filing, the 52-year old who sat on the jury for six consecutive weeks was never called for jury duty on April 11.

According to the filing, the “safeguards” didn’t seem to work in this case and the identity of the juror was not verified.

Fox News Digital was told by Neama Rahmani, a former U.S. attorney, that Heard’s legal team did not allege the allegations and it is not grounds for a mistrial.

Rahmani stated that juror mixing-ups could have been an “innocent mistake”, in which case Heard will lose.

“Even if the misconduct was deliberate, her lawyers will need to prove that it would have led to a challenge for cause. This means that the wrong juror couldn’t have been impartial and fair. Rahmani stated that this is a difficult hurdle to overcome.

The Fairfax County Juror Questionnaire webpage furthers the goal by requiring all County residents login using their 7-digit Juror Number, Zip Code, and ‘Birth Day ‘. These safeguards are in place, and can be relied upon to verify the identity and ensure fair trial for all litigants.”

This new filing is just one week after Heard’s legal staff asked a judge for a tossing out the $10.35million judgment in favor of Johnny Depp. They argued that the evidence didn’t support it.

They wrote that the verdict was excessive in law under the circumstances and should be thrown out.
