Federal Judge Rules Kim Davis Violated Rights When She Rejected To Marry Same-sex Couples In 2015

A federal judge ruled Friday that Kim Davis , an ex-county clerk in Kentucky, had violated two constitutional rights for same-sex couples by refusing to marry them during her term as office holder in 2015.

US District Judge David Bunning denied Davis’ motion for summary judgment in civil suits filed against her by two same-sex married couples.

A jury will decide, based on the opinion of the judge, what damages the plaintiffs are entitled to.

“It’s this Court’s opinion Davis violated Plaintiff’s constitutional right of marriage, and the only issue is the question of damages,” Bunning, who is a member of the US District Court Eastern District of Kentucky, stated in a memorandum.
