“Kim Davis is entitled protection to accommodation based upon her sincere religious belief.” Mat Staver, the chairman of the group, stated that this case raises serious First Amendment freedom to exercise religious claims and has the potential to reach the Supreme Court.

While the district court had dismissed plaintiffs’ claims against Davis as Rowan County clerk previously, it allowed Davis to continue in an individual capacity. Davis was also not eligible for qualified immunity.
