Following the legalization of same-sex marriage by the US Supreme Court in Obergefell, v. Hodges, Davis was made the county clerk for Rowan County, northeastern Kentucky. Davis claimed that issuing licenses would violate her Christian convictions against gay marriage. Bunning declared Davis in contempt before the court and sentenced her to jail .

Davis and her office repeatedly denied marriage licenses to multiple couples, including David Ermold and David Moore, James Yates, and William Smith. In September 2015, Davis was sentenced to five days in jail. Davis was later released by a deputy clerk and granted the marriage licenses to both of them.
