Federal Judge Finds Trump Most Likely to Have Committed Crimes During 2020 Election

The panel stated that its investigators had accumulated evidence showing that Mr. Trump and Mr. Eastman could be charged with criminal offenses, including obstruction of a formal proceeding of Congress and conspiracy to defraud the American people.

Judge Carter was nominated for the presidency by President Bill Clinton. He stated that it was likely that the men had not only conspired against the United States but also “dishonestly conspired” to block the joint session on January 6, 2021.

“He wrote that President Trump and Dr. Eastman launched a campaign against a democratic election. This was an unprecedented action in American history.

Judge Carter observed that Mr. Trump had “more likely than NOT” violated the law. This legal standard is used to determine whether Mr. Eastman can claim attorney-client privilege. He also noted that the former President had hosted two meetings in the days preceding Jan. 6. These meetings were “explicitly linked to persuading Vice Presidential Pence to disrupt the joint session.”

On Jan. 4, Trump and Eastman invited Vice President Pence, Greg Jacob, and Marc Short, two of his top aides to the Oval Office. Judge Carter stated that Mr. Eastman presented his plan to Vice President Pence and that he would focus on delaying or rejecting the election.

Judge Carter noted that another meeting followed on Jan. 5. During this meeting, Mr. Eastman tried to convince Mr. Jacob again to accept the scheme.
