Many documents that the committee will receive now relate to Mr. Eastman’s legal strategy to press Vice President Mike Pence to not certify electors in key swing states during Congress’ January 6, 2021, meeting. Judge Carter stated that the true driving force behind these emails was to persuade Vice-Pence to unilaterally act on Jan. 6.

According to the ruling, one of the documents is an email that contains the draft of Rudolph W. Giuliani’s memo. It recommends that Mr. Pence “reject voters from contested states”.

Judge Carter stated that this may be the first time President Trump’s team has transformed a legal interpretation under the Electoral Count Act into a daily plan of action.

Mr. Eastman had sued the panel to stop the subpoena of documents in his possession by the committee. In the lawsuit, Mr. Eastman requested to protect from release documents that he claimed were protected by the attorney-client privilege.

The committee responded by arguing that the privilege does not apply to information sent from a client or lawyer in the context of concealing or furthering a crime.
