Vallow was declared mentally ineligible to stand trial on separate charges for concealment of evidence. The murder case was stopped.

Idaho does not permit an “insanity defense,” however, it requires that defendants be able to understand the charges against them.

According to a June court order, Vallow was placed in the custody of the Idaho Department of Health and Welfare for “care and treatment at an appropriate institution.” Boyce ordered Vallow to be transferred from the Department of Health and Welfare and remanded in the custody of the Fremont County sheriff.
